Alleged Wrong-Way Driver Arraigned in Fatal Route 128 Crash

SALEM, Mass. – December 15, 2025 – Jerry Andujar Bodden, 42, of Haverhill, was arraigned today in Salem District Court in connection to a motor vehicle crash that killed David Mackey, 58, of Sandown, New Hampshire, the Office of Essex County District Attorney Paul F. Tucker states. Bodden was charged with motor vehicle homicide by reckless operation and improper operation of a motor vehicle. Bodden entered a plea of not guilty before the Hon. Randy Chapman.

The Commonwealth alleges that, at approximately 9:49 p.m. on Friday, December 12, Bodden was driving his Hyundai Elantra in the wrong direction when it collided with a Nissan Sentra in the southbound lanes of Route 128 in Danvers in the vicinity of Exit 42, or Route 35/High Street. Mackey was a passenger in the Sentra and was declared deceased at the scene. Bodden was transported to the hospital with serious injuries; the driver of the Sentra sustained minor injuries and was also transported to the hospital.

At the arraignment, Chapman set bail at $50,000 and imposed several conditions on the defendant: GPS monitoring; home confinement except for work, legal and medical appointments; no alcohol consumption and alcohol monitoring; and no driving throughout the duration of the case.

Assistant District Attorney Patrick Collins handled the arraignment on behalf of the Commonwealth and told the court that the Commonwealth will be filing additional charges tied to the defendant allegedly operating the motor vehicle while under the influence of alcohol. Bodden, who was represented by attorney James Milligan, is scheduled to return to court on Wednesday, January 21.

The crash investigation involved the Office of the Chief Medical Examiner, Massachusetts State Police (MSP) Troop A Detectives, MSP Danvers, MSP Collision Analysis and Reconstruction Section, and the MSP Crime Scene Services Section.

All suspects and defendants are presumed innocent until proven guilty in a court of law.
